Provisional Measures for Rewarding Technology Trading in Shanghai University Technology Market

In order to promote industry-university research, accelerate the implementation of the innovation-driven development strategy, open the channel for the combination of science and technology and the economy, promote mass entrepreneurship and innovation, encourage research and development institutions, colleges and universities, enterprises and other innovative subjects and scientific and technological personnel to transfer scientific and technological achievements, and enhance the innovation capacity of enterprises, the Shanghai National University Technology Market launched the "Interim Measures for Rewarding Technology Transactions in the Shanghai University Technology Market".

Provisional Measures for Rewarding Technology Trading in Shanghai University Technology Market

Article I (Purpose)

These measures have been formulated in the spirit of the Several Provisions of the Law on Transformation of Scientific and Technological Achievements (Law on Transformation of Scientific and Technological Achievements), the Opinions of the General Office of the People's Government of Shanghai Municipality on the Issuance and Issuance of the Opinions on the Implementation of Further Promoting the Transfer and Transformation of Scientific and Technological Achievements, and the Plan for Shanghai Systematically Promoting Comprehensive Innovation and Reform Experiment and Accelerating the Establishment of Science and Technology Innovation Center with Global Influence.

Article II (competent authorities)

The Shanghai National University Technology Market (hereinafter referred to as NUTT) implements the application, examination, implementation and management of technology trading awards for universities and research institutes in the city.

Article III (Subjects of awards)

Service agencies, brokerage teams and brokers who facilitate the transfer of scientific and technological achievements of the city's universities and research institutes on the Shanghai national university technology market platform, and who meet the following conditions, are eligible for special awards.

(i) The owners of the scientific and technological achievements that led to the transaction are universities and research institutes based in the city.

(ii) The scientific and technological achievements that lead to the transaction must be subject to a tripartite agreement, with Party A being the university or research institute, Party B being the demand unit and Party C (the intermediary) being the NUTT.

(iii) The scientific and technological achievements that led to the transaction must be confirmed by the seal of the Shanghai national university technology market.

(iv) There are no disputes over ownership of the scientific and technical results that led to the transaction.

Article IV (Amount of the award)

(i) Total prize money.

The total amount of the special award NUTT will be announced on the Shanghai University Technology Market Platform (WeChat, Weibo and website) in January every year.

(ii) Calculation of bonuses.

Agencies, teams, and individuals who are in compliance with Article III of these Measures may receive technical transaction incentives in the following amounts.

The maximum incentive for a single contract is limited to $30,000, in proportion to the amount of technology transaction contract turnover.

For example, if the transaction contract is $3,000,000, then the corresponding incentive amount is 100 x 0.51 TP1T + (300-100) x 0.31 TP1T = 1.1 ($10,000,000).

(iii) Distribution of awards.

The award is a one-time payment after the applicant submits the relevant documents and the NUTT approves the award, and the tax is withheld by the university technology market and the tax rate is paid on the one-time income.

Article V (Submission of materials for special awards)

Institutions, teams and individuals applying for the NUTT Technology Trading Award are required to submit the following documents.

(i) NUTT Technology Transaction Award Application Form (see Annex 1).

(ii) List of NUTT Technology Transaction Incentives (see Annex 2).

(iii) Tripartite Technology Transfer Contract (see annex 3).

(iv) Business license and articles of association (photocopy) for business applicants and photocopy of ID card for individual applicants.

(v) Invoices and payment vouchers, etc.

Article VI (Processing of special awards)

In principle, the period of processing of technology transaction awards for universities and research institutes will not exceed six months after the signing of the contract, which will be processed in NUTT; the technology transaction awards for universities and research institutes will be processed all year round, and the awards will be paid in one time after the materials are confirmed.

Article VII (Limitation of special awards)

Institutions, teams and individuals who have received awards for technology trading from universities and research institutes are in principle limited to 10 projects per year.

In principle, those who have achieved multiple transfers of the same technological achievement may not be rewarded repeatedly.

Article 8 (Suspension of special awards)

NUTT has the right to make a decision to suspend an award if it finds any of the following in its review of a special award application.

(i) Suspected of extracting special incentive fees or other fraudulent activities.

(c) In cases that fall under the special incentive restrictions set out in Article 7 of this Law.

(iv) Clearly ineligible for an award.

(v) Other cases of suspected violation of laws, regulations and relevant policy provisions.

Article 9 (Investigation of suspension of awards)

The NUTT shall make a decision on whether or not to grant an award for an award application that is suspended, after investigation and verification.

If a special award applicant refuses to cooperate with the investigation, he or she is deemed to have voluntarily abandoned the award processing.

Article X (Review)

Depending on the circumstances, the NUTT may establish a review panel to review the special award, and the awardee organization, team and individual should cooperate.

Article XI (Liability of applicants for awards)

Institutions, teams and individuals applying for awards shall submit authentic documents and vouchers. Applicants who have been denied an award for fraudulent reasons may not apply for a special award within two years from the date of receipt of the written decision not to award.

Reward applicants to fraudulently obtain special award fees, the circumstances constitute a crime, transfer to the judicial organs to deal with.

Article 12 (Confidentiality provisions)

NUTT files and seals the reported material and does not share the information with any entity or individual without the consent of the filing party, except where disclosure is required by law.

Article 13 (Interpretation and entry into force)

These measures shall be interpreted by the Shanghai National University Technology Market.

This measure is effective August 1, 2016.
